Terms of Service

    These Terms of Service ("Terms") are a legal agreement between you and Sharp Test Prep, Inc. ("Sharp," "we," "us"). They govern your access to and use of our websites, apps, and services (collectively, the "Service").

    1) Acceptance of Terms

    By creating an account, accessing, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

    2) Eligibility

    Sharp is designed for students preparing for standardized tests and may be used by minors.

    You must be at least 13 years old to use the Service. The Service is not intended for children under 13. If we learn a user is under 13, we may terminate the account and delete associated information.

    If you are under 18, your parent or legal guardian is responsible for ensuring your use of the Service complies with applicable law. For paid plans and purchases, a parent or legal guardian must purchase any subscription on your behalf and is responsible for all charges.

    3) Account Registration and Security

    You agree to:

    • Provide accurate, current information
    • Maintain the security of your credentials
    • Notify us promptly of unauthorized access to your account
    • Use the Service only for lawful purposes and in compliance with these Terms

    4) What Sharp Provides

    Sharp provides tools for test preparation (e.g., practice questions, skill analytics, study planning, and explanations). We do not guarantee any score increase, admission outcome, scholarship outcome, or specific results.

    5) Subscriptions, Billing, and Trials

    Sharp may offer paid subscriptions that unlock additional features.

    A) Web subscriptions (Stripe or other web payments)

    If you purchase a subscription on our website:

    • Your subscription auto-renews unless canceled before the renewal date.
    • You authorize us (and our payment processor) to charge your payment method on a recurring basis.
    • You can cancel anytime via your account settings or by contacting support at team@getsharp.app. Cancellation stops future renewals; you'll retain access through the end of the then-current billing period.
    • If pricing changes, we will provide notice as required by law; changes apply at the next renewal unless otherwise stated.

    B) iOS subscriptions (Apple In-App Purchase)

    If you subscribe in the iOS app, payment is processed by Apple and managed through your Apple ID subscription settings. Apple's billing terms apply and Apple handles many refund decisions.

    C) Free trials and promotions

    If we offer a free trial:

    • Unless you cancel before the trial ends, your subscription will automatically convert to a paid subscription and renew as described above.

    D) Refunds

    For iOS purchases, refunds are generally handled by Apple. For purchases made on our website, unless required by law or stated at checkout, fees are generally non-refundable and we do not provide prorated refunds for partial billing periods. However, you can cancel anytime to stop future renewals, and you'll keep access through the end of your current paid period.

    6) Acceptable Use

    You agree not to:

    • Reverse engineer, copy, or misuse the Service (except where prohibited by law)
    • Circumvent paywalls, authentication, or access controls
    • Use the Service to harass, exploit, or harm others
    • Upload malware or attempt unauthorized access to systems
    • Use the Service in a way that violates applicable laws or third-party rights

    7) Content and Intellectual Property

    Sharp and its licensors own all rights, title, and interest in the Service, including software, design, text, graphics, and our question/explanation content (excluding user-provided content). You receive a limited, non-exclusive, non-transferable license to use the Service for your personal, non-commercial test prep purposes, subject to these Terms.

    8) User Content (if applicable)

    If you submit content (e.g., messages, uploads), you grant Sharp a worldwide, non-exclusive license to host, store, reproduce, and display that content solely for operating and improving the Service. You represent you have the rights to submit that content.

    9) Third-Party Services

    The Service may integrate with third-party services. We are not responsible for third-party services, and your use of them may be governed by their terms.

    10) Availability; Changes

    We may modify, suspend, or discontinue the Service (in whole or in part) at any time. We aim for high availability but do not guarantee uninterrupted access.

    11) Disclaimer of Warranties

    To the maximum extent permitted by law, the Service is provided "as is" and "as available." We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

    12) Limitation of Liability

    To the maximum extent permitted by law, Sharp will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of the Service.

    13) Termination

    You may stop using the Service at any time. We may suspend or terminate your access if we believe you violated these Terms or if necessary to protect the Service, users, or third parties.

    14) App Store Terms (iOS)

    If you download our iOS app from the Apple App Store, your use of the app is also subject to Apple's Licensed Application End User License Agreement ("Standard EULA") unless we provide a custom EULA, and apps are licensed, not sold.

    15) Changes to These Terms

    We may update these Terms from time to time. If changes are material, we will provide notice (e.g., via email or in-product notice). Continued use after the effective date means you accept the updated Terms.
